1. Licensing & Intellectual Property

• Grant of License: We grant you a revocable, non-exclusive license to use downloaded content for personal, non-commercial purposes on your own devices.
• Restrictions: You may not sell, rent, lease, sublicense, or distribute the content. You may not use the content to train other AI models.
• Ownership: All rights, title, and interest in the Service and its content remain with AnimeWallFX.
• Feedback Rights: If you submit ideas or suggestions to us, we may use them freely without compensation or obligation to you.

2. Nature of AI Content

You acknowledge that our content is generated with the assistance of Artificial Intelligence.

• Artistic Imperfections: Minor artifacts, structural inconsistencies, or text blurring typical of AI generation are considered intended stylistic choices, not defects.
• Uniqueness: While we strive for originality, the nature of generative AI means we cannot guarantee that elements of our work will never resemble other existing works.

3. User Conduct & Prohibited Acts

You agree NOT to:

• Use our wallpapers in content that promotes hate speech, violence, or illegal acts.
• Harass, abuse, or harm other members of our community (including on Discord).
• Attempt to reverse-engineer our site code, API, or security features.
• Use automated scripts to mass-download content or scrape metadata.
• Impersonate AnimeWallFX staff or claim false affiliation.

4. Termination of Access

AnimeWallFX reserves the right to suspend or terminate your account immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the Service ceases, though your personal license for previously purchased files survives unless revoked for copyright infringement.

5. Indemnification & Liability

• Indemnity: You agree to indemnify and hold AnimeWallFX harmless from any claims arising out of your violation of these Terms or misuse of the Service.
• Limitation of Liability: To the maximum extent permitted by law, AnimeWallFX shall not be liable for indirect, incidental, or consequential damages (including data loss).
• Service Changes: We reserve the right to modify, suspend, or discontinue any part of the Service at any time without liability.

6. External Links

Our Service may contain links to third-party websites (e.g., Discord, Social Media). We are not responsible for the content, privacy policies, or practices of any third-party sites. Access them at your own risk.

7. Force Majeure

We are not liable for any failure to perform our obligations where such failure results from any cause beyond our reasonable control, including mechanical, electronic, or communications failure, or acts of God.

8. Severability & Waiver

If any provision of these Terms is found to be unenforceable, that provision will be limited to the minimum extent necessary, and the remaining Terms will remain in full force. Failure to enforce any right does not constitute a waiver of that right.

9. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in India.
